Terms and Conditions for the Online Shop
English translation for your convenience – the German version is legally binding.
1. Scope and customers
These terms apply to all orders placed in the online shop of Flockenhaus GmbH & Co. KG, Frankfurter Str. 5, 36124 Eichenzell, Germany. The shop is intended exclusively for business customers (companies, self-employed persons, public authorities and institutions). We do not sell to consumers; there is therefore no statutory right of withdrawal.
2. Conclusion of contract
The presentation of products in the shop is not a binding offer. By clicking “Place binding order” you submit a binding offer. The acknowledgement sent automatically by e-mail does not constitute acceptance. The contract is concluded when we send the order confirmation or deliver the goods.
3. Prices and payment
All prices are net in euros, exclusive of value-added tax and shipping. Within Germany, payment is possible by invoice (30 days net), prepayment or PayPal. For deliveries abroad we deliver against prepayment. Intra-Community supplies to businesses with a valid VAT ID are invoiced without VAT; exports to countries outside the EU are VAT-exempt.
4. Delivery
Delivery is ex works Eichenzell. Shipping costs within Germany are shown in the shop; shipping costs abroad depend on weight, dangerous-goods regulations and destination and are stated in the order confirmation. Delivery times are approximate unless expressly agreed as binding. Partial deliveries are permitted where reasonable.
5. Retention of title
The goods remain our property until full payment of all claims from the business relationship.
6. Warranty and liability
The statutory warranty provisions for business customers apply. Technical information and application advice are given to the best of our knowledge but do not release the customer from carrying out their own tests. Liability for slight negligence is excluded except for breach of essential contractual obligations and for damage to life, body or health.
7. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of performance and jurisdiction is Fulda, Germany. Our general terms of delivery and payment apply in addition.
